Establishing a Wrongful Death Claim
In Connecticut, a wrongful death claim must be filed by the executor or
administrator of the deceased person’s estate. If the deceased individual
died without creating an estate plan or will which appointed an executor
or administration, or if the appointed executor or administration can’t
uphold their duty, the court may select an executor or administrator.
The executor or administrator must file the lawsuit within
two years of the date of the decedent’s death. When the wrongful death lawsuit
is successful in court, damages are paid to the estate of the deceased person.
